SAN ANDREAS BOARD OF COMMISSIONERS

The Los Santos Police Department and the Office of Chief’s are held accountable by the San Andreas Board of Commissioners. The Commissioner’s are authorized to conduct independent investigations on the department and are also responsible for escalated disciplinary hearings and any appeals.

 

 

BUREAU OF CENTRAL OPERATIONS

The Bureau of Central Operations is commanded by a Commander who reports to the Office of Chiefs. The Bureau consists of three divisions: Patrol, Traffic and Detectives - each of which are commanded by a Captain with the support of a Lieutenant.

 

Officers may only be assigned to one Central Operations division at a time, unless authorised by a Chief.

 

BUREAU OF SPECIAL OPERATIONS

The Bureau of Special Operations is commanded by a Commander who reports to the Office of Chiefs. The Bureau consists of three divisions: SWAT, K9 and Air Support - each of which are commanded by a Captain with the support of a Lieutenant.

 

Officers may be assigned to multiple Special Operations divisions at a time but must always be assigned to at least one Central Operations division.

PRIORITY TRANSMISSIONS

Officers should use the voice radio to broadcast priority messages. “Unit number priority” and if there is a dispatcher, wait for their response. If there is no dispatcher then officers can proceed with their priority message. When an officer calls a priority, all units should remain quiet on the radio and wait for the priority transmission.

 

Priority transmissions can be for anything that requires immediate attention, such as but not limited to: pursuits, shots fired, medic needed, situation escalating quickly.

 

PANIC BUTTONS

Any activation of a panic button is to be treated as a Code 99 emergency and all available units should respond immediately. If the Code 99 officer calls on the radio claiming that the activation was an accident then units should continue to respond to the location until a secondary officer can confirm there is no threat to life. This is to ensure the officer is not under duress.

 

RADIO CODES

 

  • Code 1 - Non-emergency, no ELS, follow all traffic laws.

  • Code 2 - Urgent but not emergency, can use ELS to get through heavy traffic.

  • Code 3 - Emergency, use ELS at all times, change tone when clearing intersections.

  • Code 4 - Incident resolved.

  • Code 99 - Officer requires emergency assistance.

UNIFORMS

Officers only have access to the uniforms that they are authorised to wear. Officers should always wear the uniform that is relevant to the tasks they are performing (i.e. do not wear a SWAT uniform if you are conducting speed enforcement). The uniforms are listed below, please note that detectives and command staff are authorised to wear plain clothes or different LSPD branded clothing.

Activity, Rank and Promotion Policy

 

INTRODUCTION

 

1.1 - This document outlines the activity, rank and promotion requirements for the Los Santos Police Department.

 

1.2 - This document is maintained by the Human Resources division.

 

ACTIVITY 

 

2.1 - Officers must meet their activity requirements as set forth below:

2.2 - Failure to meet activity requirements can result in disciplinary action.

 

2.3 - Certain divisions or roles may have additional activity requirements.

2.4 - Officers will not have to meet their activity requirements if they have an authorised leave of absence. Officers must submit a leave of absence request prior to their absence.

 

2.5 - Leave of absences are approved at the discretion of the officer’s Bureau Commander, or a Chief if the officer is the rank of Commander.

PROMOTIONS

 

4.1 Officers ranked Sergeant and above are authorised to promote other officers, but only to a rank at least 2 below themselves. (E.g. A Sergeant can promote to Officer Grade 2, but Sergeant Grade 2 can promote to Officer Grade 3)

 

4.2 For a recruit to be promoted to the rank of Police Officer Grade 1, they must complete their Phase 1 training and be sworn in by another officer at the rank or Sergeant or above.

 

4.3 Officers at the rank of Grade 1 are in their probationary period and must not patrol alone. They can be accompanied by an officer of Grade 2 and above.

Field Training Officers (FTO's)

Recruits and Probationary Police Officers (Grade I), must be accompanied by a field training officer at all times during a patrol. Field Training Officers are those of Officer Grade III and above.

 

Mandatory Scenarios

Probationary Police Officers (Grade I) must be the primary officer in the following scenarios to an acceptable standard before they pass their probation.

  • Foot pursuit

  • Vehicle pursuit

  • Code 3 response

  • Taser deployment

  • Booking suspect into custody

 

Performance Review

Field Training officers must grade their officers in the following categories:

  • Law knowledge

  • Professionalism

  • Confidence

  • Radio communications

  • De-escalation

Field Training Officers must submit a performance review after every patrol or training event and ensure it is added to the officers file.

 

Disciplinary Action

In some cases, officers that have already passed probabtion may be disciplined as an outcome of an Internal Affairs or Professional Standards investigation, requiring a satisfactory performance review.

Officers must only be performance reviewed by an officer at least one rank senior to them.

Upon completion of phase 1 training, and to become a probationary officer. The officer must swear by the Oath of Honor. Failure to do so will result in immediate dismissal.

1.1 This document outlines disciplinary actions and appeals for internal matters relating to the Los Santos Police Department (known hereon as LSPD). 

 

1.2 This document may be edited with immediate effect at the discretion of the chiefs of department.

 

1.3 The document owner is the Captain of Professional Standards, should this role fall vacant ownership will temporarily transfer to the Office of the Chiefs of Department. 

 

1.4 This document applies to anyone employed or contracted by the LSPD and may be enforced even after employment has terminated. 

 

CLASSIFICATION OF MISCONDUCT

 

Minor Misconduct

 

MMC01 - Unprofessional Conduct - Officer behaves in a way which is contrary to the high standards expected while interacting with colleagues or members of the public.

 

MMC02 - Minor Traffic Violations - Officer operates a vehicle in a way which is contrary to the law and/or standard operating policy (known here on as SOP) within the LSPD and has no legally justified excuse but does not put any person in danger of immediate harm.

 

MMC03 - Unlawful Search - Officer conducts a search on a person, property, or vehicle without proper justification. 

 

Misconduct

 

MIS01 - Unlawful Charge - Officer has charged a person without sufficient evidence or legal authority. 

 

MIS02 - Unlawful Entry - Officer has entered a property to which he was not entitled to do so and without legal justification but did not use force to gain access. 

 

MIS03 - SOP Violation - Officer has not performed their duties in accordance with the SOP and have no legal justification for doing so.

 

MIS04 - Policy Violation - Officer has acted against any policy to which they are bound to follow and have no legal justification for doing so.

 

Gross Misconduct

 

GMC01 - Insubordination - Officer has shown disregard for the chain of command by failing to carry out the lawful orders of a higher rank.

 

GMC02 - Major Traffic Violations - Officer operates a vehicle in a way which is contrary to the law and/or SOP within the LSPD and has no legally justified excuse and puts any person in danger whether actually causing them harm or not.

 

GMC03 - Dishonesty - Officer has attempted to deceive colleagues or members of the public with no operational purpose or legal authority.

 

GMC04 - Excessive Force - Officer has used an unnecessary amount of force in relation to the threat a reasonable officer would perceive. 

 

GMC05 - Shooting Violation - Officer has unlawfully discharged their firearm. 

 

GMC06 - Duty of Care - Officer have acted contrary to their duty of care for all civilians and colleagues as defined in the SOP.












TYPES OF DISCIPLINARY ACTION

 

2.1 Retraining: Retraining is the least serious type of disciplinary action and involves you undergoing a part of your training for any division over again. You may also be ordered to attend a training course which you have not before completed which may be specifically targeted at officers found to be in breach of policy. You must attend a training session booked for you within 28 days, unless you are unable due to the lack of sessions available. A notice of retraining will be added to your disciplinary record and is permanent, it does not by itself bar you from applying for any role within the LSPD and should not be considered negatively by a recruiting officer. Retraining can be issued for any type of misconduct and may be accompanied by another form of disciplinary action. 

 

2.2 Reprimands: A temporary entry onto your disciplinary record which lasts 28 days. A reprimand should be seen as a notice to improve your behaviour however they will bar you from applying for any other role within the LSPD for their duration. Reprimands can only be issued for minor misconduct or misconduct.

 

2.3 Written Warning: A written warning does not expire automatically like a reprimand does however, after 90 days you may write to the Professional Standards Department (known here on as PSD) with an apology and evidence of your improvement from the date it was first issued for it to be rescinded. A written warning will only bar you absolutely from applying for other roles within the LSPD for the first 28 days after this it will remain on your record however it will be at the discretion of whomever is the recruiting officer to deny you on account of your disciplinary record. A written warning may be issued for any type of misconduct.

 

2.4 Restrictive Duties: Restrictive duties may be necessary when an investigation is taking place or you may be placed on permanent restrictive duties. If on a permanent basis this must be reviewed regularly by your line manager with the aim of returning you to full duties as soon as possible. You can be restricted from doing any type of duty and it should be specified what duties you are restricted from when the action is issued. Restrictive duties can be issued during an investigation by PSD command or the chiefs. Restrictive duties can also be a punishment for any type of misconduct. 

 

2.5 Demotion: Demotion must be authorised by any chief and generally can only move you down by one rank however this can be overridden by the chiefs. You may also be demoted from a specific division and not necessarily have a change in actual rank.

 

2.6 Dishonorable Discharge: Dishonorable discharge should only be considered for the most serious misconduct however it could also be considered for repeat offenders who have been previously issued corrective or disciplinary action. Dishonorable discharge must be authorised by a chief.



ISSUING OF DISCIPLINARY ACTION

 

3.1 Retraining may be issued by any officer ranked Sergeant and above to any officer of lower rank than them. Officers must not issue retraining for division specific training for a division they are not themselves a part of.

 

3.2 Reprimands may be issued by any officer ranked Sergeant and above to any officer of lower rank than them.

 

3.3 Written warnings may be issued only by the Chair of the Ethics Committee by recommendation from a vote of the Ethics Committee or by the Head of PSD or by any Chief. 

 

3.4 Restrictive duties may be issued by an officer’s Line Manager for division specific duties. Restrictive duties may be issued by the Chair of the Ethics Committee by recommendation from a vote of the Ethics Committee or by the Head of PSD or by any Chief.

 

3.5 Demotion may be issued by the Chair of the Ethics Committee by recommendation from a vote of the Ethics Committee or by the Head of PSD or by any Chief. Demotion from a specific division may be done by the head of that division with authorisation from a Chief. Authorisation must be sought from a Chief before carrying out this action. 

 

3.6 Dishonorable discharge may be issued by the Chair of the Ethics Committee by recommendation from a vote of the Ethics Committee or by the Head of PSD or by any Chief. Authorisation must be sought from a Chief before carrying out this action. 

 

APPEALS PROCESS

 

4.1 The grounds which an appeal may be brought are as follows:

  • Policy: You believe the action taken was contrary to policy

  • Insufficient Evidence: You believe there is insufficient evidence to prove your alleged incorrect actions which lead to disciplinary action.

  • Unjust Punishment: You believe the punishment is unfair based on the misconduct committed and your disciplinary record. 

  • New Evidence: You have new evidence which would prove your actions were in line with policy/lawful.

 

4.2 Appeals must be made within 28 days of disciplinary action.

 

4.3 If the disciplinary action was issued by the Ethics Committee you must appeal to the Chiefs of Department.

 

4.4 If the disciplinary action was issued by the Head of PSD you must appeal to the Chiefs of Department.

 

4.5 If the disciplinary action was issued by a Chief of Department you must appeal to the San Andreas Board of Commissioners.

 

4.6 The appeal should always be handled by someone separate from the investigation and from the issuing of the disciplinary action. If this is not possible it should be directly overseen by a Chief of Department. 

 

4.7 Only one appeal may be made per disciplinary action, unless further evidence is being provided.

Los Santos Police Department

Use of Force Policy



TERMINOLOGY

 

High-risk suspect - Any suspect that has committed a violent felony, or is likely to commit a violent felony and would pose a threat to public safety if not in custody.

 

LEVELS OF FORCE

 

LEVEL 1 - NONE

No force should be used against any suspect or civilian who is compliant and does not pose any threat. If the suspect is to be arrested but is compliant then handcuffs can be used.

 

LEVEL 2 - MILD

If a suspect or civilian is failing to comply with verbal commands or is obstructing an officer in a non-violent manner then officers are authorized to use mild force to control the subject. Using force such as verbal commands, pushing, baton and handcuffs.

 

LEVEL 3 - LESS THAN LETHAL

Less than lethal force should only be used when a suspect is non-compliant, aggressive, threatening, likely to cause injury or a high-risk suspect is likely to escape custody. In this situation, officers are authorized to use their tasers, tear gas or flashbangs.

 

LEVEL 4 - LETHAL

Officers are authorized to use deadly force for the purpose of preservation of life. If a suspect poses an imminent threat to life, or a high-risk suspect is fleeing then officers can use their department issued firearms to neutralise the threat.

 

PRESERVATION OF LIFE

Officers always have a duty to protect life. This even applies to suspects that have had lethal force used against them. Once the imminent threat to life has been neutralised, officers should make every attempt to preserve the life of the suspect by rendering emergency medical care and requesting paramedic attendance.
